1. Overview & Acceptance

Duskbloom Littles ("we," "us," or "our") provides educational videos, printable activities, interactive games, and related resources for children and the adults who support them. By accessing or using our website or downloadable materials (collectively, the "Services"), you agree to these Terms of Use, our Privacy Policy, and our Child Safety Policy. If you do not agree, do not use the Services.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

2. Audience, Eligibility & Supervision

• The Services are designed for children with active involvement from parents, guardians, or educators.
• We do not create user accounts or knowingly collect personal information from children under 13.
• Adults are responsible for supervising children’s online activity and ensuring that any material is appropriate for the child’s age, abilities, and learning goals.
• Certain external experiences, such as our Ko-fi support link, are offered only to individuals aged 13 or older. Adults should complete any purchases or provide consent before a child follows links away from our site.

3. Educational & Informational Purpose

Our videos, games, and printable materials are intended to supplement formal education by offering fun, exploratory learning moments. We do not promise specific learning outcomes, and the Services should not be considered a substitute for professional educational, medical, psychological, or legal advice. Adults should use their own judgment when applying the information presented.

4. Limited License to Use Content

We grant you a limited, non-exclusive, non-transferable license to view, print, and share our content for personal, household, or classroom educational use only. You may not sell, license, redistribute, host, publish, or create derivative works from our materials without our prior written permission. Do not remove watermarks, branding, or copyright notices.

Educators may distribute our materials within their own classrooms or institutions so long as the materials remain unaltered and are not packaged for sale. To request broader usage rights, please contact us at educators.littles@duskbloomdiscovery.com.

5. Downloadable Resources

• Printable workbooks, coloring books, and activity packs are provided "as is" without warranties.
• We scan for malware, but you should always use reputable antivirus tools before opening downloaded files.
• Do not upload or host our files on third-party platforms or publicly accessible drives.
• Adults should supervise printing, cutting, or crafting activities to promote safe tool usage and a positive learning environment.

6. Premium Resources & Refund Policy

We offer premium digital resources (such as workbooks, activity packs, and educational materials) for purchase. All premium resources are delivered as digital downloads. Due to the nature of digital products, all sales are final and non-refundable once the files have been downloaded or the download link has been accessed.

If you experience a technical issue that prevents you from accessing or downloading a purchased resource, please contact us within 14 days of purchase and we will work to resolve the issue or provide a replacement.

Premium resources are subject to the same license terms described in Section 4 (Limited License to Use Content). Purchasing a resource does not transfer ownership of the intellectual property.

7. Interactive Games & Quizzes

Our online games, puzzles, and quizzes are intended to provide an engaging way to review concepts and problem-solving skills. Activity pacing, difficulty, and accessibility may vary by device. We do not guarantee uninterrupted operation, compatibility with every browser or device, or specific knowledge outcomes. Adults should monitor screen time and ensure children take breaks as needed.

You may not copy, embed, or host our interactive experiences elsewhere without our written consent. Any unauthorized automated access or scraping of the games is strictly prohibited.

8. Intellectual Property

All content on the Services—including videos, illustrations, the Bloomy mascot, logos, text, graphics, and downloadable files—is owned by Duskbloom Littles or our licensors and protected by intellectual property laws. You may not use our trademarks, trade dress, or brand assets without prior written permission.

9. Acceptable Use

• Do not misuse the Services, interfere with security, or attempt to gain unauthorized access.
• Do not scrape, crawl, harvest, or collect data, including in-game content or resource files.
• Do not use the Services to promote commercial products, solicit donations, or advertise without consent.
• Do not submit content that is unlawful, harmful, or violates the privacy of children or third parties.

10. Third-Party Services & External Links

We may link to or embed content hosted by third parties, such as YouTube videos or the Ko-fi support page. Those services have their own terms and privacy practices, and your use of them is subject to their policies. We vet links for suitability but cannot control, endorse, or assume responsibility for third-party content, availability, or data handling. Leaving our site is at your own risk, and adults should supervise any child who follows external links.

11. Donations & Support

Voluntary financial contributions are processed by third-party providers. Payment information is handled exclusively by those providers, and transactions may be subject to their fees and terms. Donations are typically non-refundable. Adults must review and approve any contribution before it is made on behalf of a child.

12. Partnerships, Submissions & Testimonials

• Partnership proposals, sponsorships, and collaborations are subject to our review. Nothing on the site obligates us to enter into an agreement. Separate written contracts govern any formal partnership or paid engagement.
• By sending feedback, stories, testimonials, or ideas, you confirm that you are an adult and that the material does not include personal information about a child. You grant us a perpetual, royalty-free license to use submitted content for marketing or product improvement.
• We may decline or remove any submission that conflicts with our brand safety standards.

13. Availability & Modifications to the Services

We strive to keep the Services accessible and kid-friendly, but we may modify, suspend, or discontinue any part of the Services at any time without notice. Planned maintenance or technical issues may result in downtime. We are not liable for any loss resulting from interruptions or changes.

14. Limitation of Liability

To the fullest extent permitted by law, Duskbloom Littles, its affiliates, and team members will not be liable for any indirect, incidental, consequential, special, or punitive damages, nor for lost profits, lost data, or property damage arising from or related to your use of the Services. In no event will our total liability exceed fifty Canadian dollars (CAD $50) or the amount you paid to us in the past six months, whichever is greater.

15. Indemnification

You agree to defend, indemnify, and hold harmless Duskbloom Littles, its affiliates, and their respective directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your violation of these Terms or your misuse of the Services.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada. Before pursuing formal legal action, please contact us so we can attempt to resolve concerns informally. Either party may seek injunctive relief in court to prevent unauthorized use of intellectual property.

17. Termination

We may suspend or terminate access to the Services at any time for any conduct that we believe violates these Terms or harms other users. Sections that by their nature should survive termination (including intellectual property, license restrictions, acceptable use, limitation of liability, indemnification, and governing law provisions) will remain in effect.
